入境检查、二次检查与I-94生成流程总览

入境口岸真正决定的，不是“你有没有拿到签证”，而是“你这次是否被准许入境、以什么类别入境、能停留到什么时候”。对大多数外国旅客来说，签证只是到口岸申请入境的前置文件；真正的准入决定发生在 CBP 检查环节，最终结果会体现在 admission 结果与 I-94 记录上。[1][2]

关键变量

  • 文件够不够：护照、签证、豁免资格、旧 I-94、支持性材料，是否和这次入境目的匹配。[5]
  • 目的是否一致：签证类别、口头陈述、历史申请资料、行程安排是否互相对得上。[6]
  • 既往记录有没有问题：超期停留、旧拒绝入境、递解、材料不一致、刑事或其他 inadmissibility 问题，会在检查环节被重新看。[7]
  • 最终 I-94 写了什么：对大多数非移民来说，真正控制停留期限的是 admitted-until 日期或 D/S，不是签证页过期日。[8]

主线流程

第一步：到口岸提出“准入申请”

法律上的起点不是“我有签证所以我进来了”，而是你到美国口岸以后，向 CBP 官员当面申请 lawful entry。所有到达美国口岸的人都会经过检查；外国人要让检查官满意地确认：你文件合格、身份对得上、这次入境没有触发不可入境问题。[9][10]

第二步：先做初检（Primary Inspection）

初检是第一道口岸审查。这里通常会看身份文件、签证或豁免资格、出行目的、既往记录，必要时还会采集或核验生物信息。对非移民而言，法规直接要求申请准入时证明自己可被准入，并提交有效护照和有效签证，除非相关文件要求被豁免。[11][12]

第三步：如有疑点，转入二次检查（Secondary Inspection）

如果初检阶段还需要进一步核实，旅客可以被转去二次检查。CBP 官方说明明确写到，primary inspection 的官员对是否转 secondary 有很大裁量空间；另外，如果当场无法就某个入境人的移民状态立刻作出决定，法规和 CBP 也都保留 deferred inspection 这条后续处理路径。[13][14][15]

第四步：作出准入决定，并形成 admission / I-94 记录

如果 CBP 决定准许入境，真正重要的结果有两个：第一，你是以什么身份或类别被 admitted；第二，你的 authorized period of stay 到什么时候。国务院公开说明里也把这一点说得很清楚：CBP 在口岸决定是否准入、决定可以停留多久；I-94 上的具体日期或 D/S，才是你被允许停留多久的正式记录。[16][17]

第五步：如果不能直接准入，后果不只是一句“不给进”

口岸检查如果走不通，后面不一定只有一种结果。法规里至少明确存在几条不同轨道：例如在一定情况下允许你撤回入境申请；在特定 212(a)(6)(C) 或 212(a)(7) 文书/虚假陈述场景下，可能适用 expedited removal；如果当场无法做出决定，也可能进入 deferred inspection 等后续处理。对当事人来说，关键不是只记术语，而是搞清自己到底落到了哪一种程序上。[18][19][20]

风险与后果

  • 最大误区一：把签证页当成最终结果。 不是。签证只解决“你能不能来口岸申请入境”，不自动解决“你能不能被 admitted”。[21]
  • 最大误区二：只看签证有效期，不看 I-94。 对非移民来说，准入后真正控制停留期限的通常是 I-94 的 admitted-until 日期或 D/S。[22]
  • 最大误区三：把“二次检查”当成一个固定结论。 二次检查说明“需要进一步核实”；真正决定后果的，是最后形成的程序结果和对应文书。[23][24]
  • 最大误区四：口岸问题只影响这一次旅行。 不是。错误的 admission 记录、撤回入境申请、快速遣返、虚假陈述或文件问题，往往都会反向影响后续签证、再入境、延期换身份和绿卡申请。[25]

  1. 刚入境后先核对 I-94。 看类别、入境日期、admitted-until 日期或 D/S 是否正确。[26][27]
  2. 如果 I-94 查不到或信息不对，别只盯着签证页。 先按 CBP 的 I-94 官方路径查询；确有 admission 记录错误时，去 local CBP deferred inspection site 或相应口岸做更正。[28][29][30]
  3. 如果当场被带去二次检查或被要求签文书，先搞清程序名称。 是 admitted、withdrawal、expedited removal，还是 deferred inspection，后面完全不是一回事。[31]
